The White House says President Donald Trump is delaying action on Jay Clayton’s nomination to lead the Director of National Intelligence until Congress approves two pending items: legislation described by the administration as related to warrantless spy powers and a voter identification bill.
President Donald Trump said Wednesday he is pausing the confirmation process for Jay Clayton’s nomination to serve as Director of National Intelligence, linking the delay to congressional action on two legislative priorities, according to The Hill. The White House announcement comes as Trump’s administration seeks to advance a broad package that includes changes to federal surveillance authorities and election administration requirements, the report said.
In the announcement, Trump indicated he will hold off on moving Clayton’s nomination forward until Congress approves what the administration described as warrantless spy powers, and a voter identification bill, The Hill reported. The pause affects the timing of a senior intelligence leadership change, even as the nomination remains pending rather than withdrawn, the report said.
Trump nominated Clayton to serve as DNI after the office has been led in an acting capacity by Bill Pulte, according to the report. The Hill characterized the delay as a response to concerns raised by lawmakers about the administration’s effort to install new leadership at the DNI during a period when Congress is actively debating surveillance and voting policies.
The report also tied the nomination pause to an effort to secure clearer legislative alignment on authorities that would govern how federal intelligence activities are conducted. The Hill did not describe specific statutory text in its account, but said the administration is linking Clayton’s advancement to congressional approval of warrantless surveillance powers.
On the election administration side, Trump’s stated condition also points to a voter ID bill Congress is considering, The Hill reported. The nomination pause, as described by the administration to lawmakers, would effectively place the confirmation timeline behind legislative negotiations over voting rules rather than advancing through Senate confirmation on its own schedule.
If Congress approves the measures Trump cited, the White House would be expected to resume steps toward consideration of Clayton’s nomination, The Hill reported. Until then, leadership at the DNI would remain under acting direction, leaving the role’s responsibilities to continue under Pulte’s current status.
The next procedural step depends on what Congress takes up and what final legislative language lawmakers ultimately approve, as well as the administration’s decision on when to restart the nomination process. A formal Senate confirmation timeline was not specified in the report, and the nomination’s status could change if the administration issues further direction or if congressional action occurs first.
The administration’s decision underscores how high-profile nominations can become intertwined with separate legislative fights in Congress, particularly when both chambers are engaged in negotiations over intelligence authorities and election administration rules. Any subsequent confirmation action would require Senate consideration once the White House resumes the process.
